The 2018 Farm Bill legalized hemp and its derivatives (like CBD and THCa) as long as they contain no more than 0.3% delta-9 THC on a dry weight basis. However, compliance and testing are nuanced and regulated mainly at the state level, though the USDA provides overarching rules for licensed hemp producers.

Here’s how testing typically works under the USDA’s Final Rule (and what most states follow or base their systems on):

    1. Pre-Harvest Testing

Timing: The USDA requires hemp to be tested within 30 days prior to harvest.

    • What’s tested: Only delta-9 THC, not THCa or total THC (unless state-specific laws add that).
    • Method: Usually through post-decarboxylation or “total THC” testing, meaning they convert THCa to delta-9 THC using a formula:
      \text{Total THC} = \Delta^9 \text{THC} + (0.877 \times \text{THCa})
    • However, many labs and enforcement bodies still test for just delta-9 THC, which is crucial for products like THCa flower (because it can appear compliant pre-decarboxylation)

    2. Post-Harvest Testing

Optional or state-specific: Some states or buyers might request post-harvest or final product testing (e.g., smokable flower, vapes, edibles) for quality control, potency, or retail compliance.

    • Risk of higher THC: After harvest, THCa can convert to delta-9 THC through drying, heat (smoking or extraction), or degradation. So if post-harvest testing is done after curing or processing, it could show higher delta-9 levels than the crop did pre-harvest.
    • This can make a product appear non-compliant, even if it passed pre-harvest testing.

Best Practice for Compliance (Especially with THCa Flower):

Follow strict pre-harvest testing 30 days prior, use a DEA-registered lab, and document all results.

    1. Test post-harvest samples for internal QA/QC, especially if selling across state lines or in states with stricter rules.
    2. Store test results and certificates of analysis (COAs)—you may need to prove compliance during shipping or inspections.
    3. Avoid high heat or long curing that could boost delta-9 THC via THCa degradation.

    Key Points:

Testing after harvest may yield different results due to natural chemical changes (THCa turning into delta-9 THC).

    • The legal benchmark is pre-harvest testing (within 30 days), but states may add post-harvest requirements.
